Estate planning encompasses many decisions, including whether to execute a will or a revocable living trust, or other kinds of trusts. It concerns how to shelter the most amount of money from the government on death. Depending upon the size of your estate, at your death, the government can take up to 47% of your assets.
Even more important than taxes, you may also want the best way to protect your children in the event of death or disability. For example, what kind of trust to establish (revocable or irrevocable), and at what age to permit your children to enjoy your estate. Also, how best to both protect your spouse, as well as your children from former marriages.
You might also have a child with special medical needs, and will want the most efficient trust to provide for the needs of that child yet maintain government assistance such as social security and Medicare benefits.
You may also want to prepare for incapacity, including medical directives, living wills, and durable medical and legal powers of attorney.
